Obama begins, "I, Barack Hussein Obama, do solemnly swear ... " That starts the door swinging shut; the latch is slid home when he reaches the period at the end of the sentence. (One aspect of my work requires "certifying", and I've actually had to research what is sufficient in order to argue that a particular document we had should be accepted as a written certification. I also do a lot of swearing at work.  ) OK, as an outsider I think I'm missing something. What's up? |

I mean that when one must legally swear, affirm or pledge a thing, it's sufficient to say "I swear/pledge/affirm ..." without having to append "so help me God" at the end. Since each president begins "I, [state your name], do solemnly swear ...", the legality of it being a sworn oath has been satisfied; and the oath itself then is finished when the swearer says "... Constitution of the United States." |

Spacey: The original text says the oath SHALL be administered, else the man cannot enter on the office. However, Amend. XX says the man assumes his duties at noon on 20 JAN. Period.
To the extent they conflict, Amendment XX supersedes Article II. They do. Amend. XX makes no mention of the oath, dropping it in status from mandatory to ceremonial.
Canons of construction require that phrases in the same law (Amendment) be read so as to accord with one another, as it was all drafted at the same time by the same folks. Why would Amend. XX, Section 1 say the guys take office at noon, then Section 3 say they don't take office until they've been administered their oaths (which cannot be done in tandem and precisely at noon)? If you/he can come up with another reasonable interpretation for Section 1 -- that is, that "and the terms of their successors shall then begin" means something other than that their terms begin -- I'm open-minded.
