I'll yield to better legal minds than mine to comment. So ditto Clive.

FWIW, people also file for divorce in order to qualify for Medicaid long-term care, and some do not see this as unethical or "dirty arse lawyering". Most likely it's the dirty arse lawyers that see it this way though.

Unless California laws are crazy (hah!), I don't see how this handicaps anything too terribly. If the couple were married, it would be assumed that either parent had gatekeeping function as to family vehicles. If divorced, the plaintiff would have to prove equal gatekeeping function. For either car, how likely is it that one and only one of the Bollea parents could grant or deny driving privileges? It's a little more work for plaintiff, but it doesn't seem insurmountable.
To my knowledge, one could sue the registered owners of the vehicle at the time of the conduct complained of. You can't escape liability for a car accident merely by selling the car before plaintiff can file his complaint.
And come on, there've been divorce rumors for months, the article says. If they just cooked it up to try to dodge liability as to one of them ...

Jeebus! I'm tired of clicking on threads and having to read a bunch of *feces*. I'm not Gen. X, but I like what they got going.
