Talk with him/her, but I suspect it's a dead end.  MI is an at-will employment state, so they can terminate employees based on high wages/salaries.  (Although if the higher-earning employees seem to be predominantly those of age 40 or older ...)  If they have any smarts whatsoever, they will never state that you were separated because of your injuries or for taking maximum FMLA leave.

If they had this layoff in the works for a little while (i.e., before you were cleared for work, which it sounds like) and the targeting was based on high-earners, it's going to be a severely uphill battle to prove that your particular termination was for another reason.

But MI at-will employment law isn't simple, so definitely talk to the lawyer.
